Human Rights, Disability Discrimination and Building Law
Australia is a signatory to the UDHR1948 and our Commonwealth and State law upholds international law through the Human Rights and Equal Opportunity Commission Act and the Disability Discrimination Act 1992.
Disability Discrimination is to treat a person less favorably as a result of a disability or requesting a person comply with a condition or a requirement that they are not able to comply with in the circumstances due to an impairment a they or their companion may have.

The Likelihood of Discrimination
The provision of access in a building requires financial and planning resources, hence the temptation to defer access projects.
When considering the need to improve access, Building Owners and Managers need to assess:-
· The risk of not providing access
· Their statutory obligations
· The benefits of providing access and
· Alternative forms of access
First; as the percentage of the population over 60 years increases so to does the disability rate and the frequency of successful complaints.
Similarly, the benefits of providing access to a growing consumer and employment market, such as people over 60, has advantages for companies with good access.
